  • as if today's Supreme Court ruling
  • wasn't bad enough there was a single
  • section slipped into this immunity
  • decision that will have massive
  • implications for Donald Trump's
  • prosecution in Florida now you'll
  • remember that less than two weeks ago
  • judge Cannon held oral arguments on the
  • motion submitted by Trump to dismiss the
  • Florida classified documents indictment
  • altogether on the grounds that Jack
  • Smith the special counsel was
  • unconstitutionally appointed now let's
  • be clear before today this would have
  • been should have been laughed out of
  • court we have been using special
  • councils in this country since the 1800s
  • the notion that special councils
  • Prosecuting cases is improper is based
  • on quite literally nothing it was
  • invented by the Trump team out of whole
  • cloth which brings me to this part of
  • Justice Clarence Thomas's opinion from
  • today I write separately to highlight
  • another way in which prosecution May
  • violate our constitutional structure in
  • this case the Attorney General purported
  • to appoint a private citizen as special
  • counsel to prosecute a former president
  • on behalf of the United States but I am
  • not sure that any Office of the special
  • Council has has been established by law

  • as the Constitution requires in other
  • words if judge Cannon actually grants
  • Trump's absurd motion to dismiss the
  • case on these grounds Thomas has already
  • signaled that if and when it makes its
  • way to the Supreme Court that it would
  • already have a sympathetic Justice in
  • him that is how corrupt judges signal to
  • each other that they're all on board
  • with helping a corrupt criminal
  • defendant in Donald Trump avoid
  • prosecution BR crimes honestly with
  • judges like these who even needs defense
  • attorneys and what's most agreed
  • this issue had nothing to do with the
  • case at hand Donald Trump's attorneys
  • never even brought this issue up in
  • court it wasn't even being litigated
  • this was solely solely because Clarence
  • Thomas saw what was happening in Florida
  • and wanted to send a little signal flare
  • to judge cannon that if she Ops to give
  • Trump the gift of a dismissal in Florida
  • that she'll have at least one vote if
  • not more if and when they appeal
  • inevitably lands in front of the Supreme
  • Court to say this is Clarence Thomas
  • overstepping would be the understatement
  • of the century and that's a point by the

  • way that Glenn kersner made in our most
  • recent episode of the legal breakdown
  • you'll remember that that one of the
  • justifications that Donald Trump put
  • forward of bogus on its face
  • justification that he put forward to
  • dismiss the the Florida indictment was
  • this idea that Jack Smith as a special
  • counsel doesn't have a basis to
  • prosecute this case we've used special
  • counsels for well over a hundred years
  • in this country dating back to the 1800s
  • but now Justice Thomas Clarence Thomas
  • has signaled in this Supreme Court
  • ruling that he's actually opposed to
  • that and aligns himself with this uh
  • with this Trump attorney um uh theory
  • that that in fact there is no basis to
  • appoint special councils to prosecute
  • these cases what are the implications
  • going to be down in Florida first of all
  • Brian that had nothing to do with this
  • Supreme Court case right nothing was not
  • an issue involved in this litigation so
  • what you just read was Clarence Thomas

  • and his conflict on his sleeve
  • announcing to just judge Cannon down in
  • Florida hey I got you why don't you just
  • go ahead and Grant the motion to dismiss
  • because I am of the opinion even though
  • it wasn't part of this litigation that
  • Jack Smith wasn't lawfully appointed you
  • know that in my estimation is the stuff
  • of impeachment of a Supreme Court
  • Justice and mind you Brian he is
  • conflicted he should not have
  • participated in this opinion in any
  • event neither Clarence Thomas nor
  • Justice Alito should have taken part in
  • the immunity case because they are are
  • both conflicted out because you know of
  • their wives conduct and their conduct in
  • support of the insur ction um and the

  • federal law not that the Supreme Court
  • Justices seem to care about whether the
  • federal law applies to them but it does
  • and it says a Supreme Court Justice
  • whose impartiality might reasonably be
  • questioned shall disqualify themselves
  • this adds insult to injury to corruption
  • to conflict to outright crime and I
  • think it's the stuff of impeachment well
  • the sad part about that is that obvious
  • obvously impeachment relies on having uh
  • enough members of the House and Senate
  • who are also going to be willing to vote
  • not only for impeachment which requires
  • a simple majority in the house but uh
  • two-thirds of the Senate to be able to
  • actually convict so as of right now this
  • is basically a Fool's errand considering
  • we couldn't even get uh enough Senators
  • to vote for to to convict Donald Trump
  • in the aftermath of the Insurrection
  • while that was still Fresh So the idea
  • that you know these Supreme Court
  • Justices who are just enabling him
  • without such overt action as Donald
  • Trump took on January 6th in the

  • aftermath of the Insurrection suggest
  • that we're not going to see any uh any
  • successful impeachment or conviction
  • efforts anytime soon so with that let me
  • just I I actually think this brings us
  • to the Silver Lining and yes I have to
  • close one eye and turn my head just so
  • to find that silver lining today but um
  • when you talk about how impeachment has
  • to start in the house this is yet
  • another reason that the only ones who
  • will save us are us right this has to
  • continue Contin to drive us to the polls
  • yes in numbers too big to rig and too
  • real to steal because the remedy for
  • what alss US is us and US voting out you
  • know but voting the house into the hands
  • of the Democrats obviously making sure
  • Donald Trump doesn't get anywhere near
  • the Oval Office so voting for President
  • Biden and then the other Silver Lining
  • because yeah we're heavy on the gloom
  • and doom today because we have to
  • accurately recount what the Supreme
  • Court just did but here's the other

  • to judge Tanya chuin and you know what
  • she gets to do she gets to begin holding
  • hearings and yes you know the
  • prosecutors have had their hands tied
  • behind their back so it may not include
  • all the evidence we would love to see
  • but she does get to hold evidentiary
  • hearings so even though it looks like we
  • won't have a trial in the DC case for
  • Donald Trump trying to overturn the
  • results of the 2020 election we will
  • have public hearings and there will be
  • evidence and there will be Witnesses and

  • courtroom of just some of Donald Trump's

  • uh uh vote suppressors uh and then make
  • sure you vote and you vote for Democrats

  • them if you're in a state with a
